DESCRIPTION

This proactive course covers many important legal issues for proactive officers and detectives. Topics include undercover operations inside homes, anonymous tips, Miranda, and much more. 

Goal

This course will help students become proficient in various advanced criminal investigation techniques, including handling informants, dealing with homes, and arrests. 

 

Outcome

Students who complete the course will:

Fourth Amendment standing

The Single Purpose Container Doctrine

Managing informants

Anonymous tips

Collective knowledge

Training Modules

1. All about burdens of proof, including a deep dive into probable cause. 

2. We train the legal issues regarding the most used search and seizures by narcotics officers, in particular:

What one of three exceptions an officer needs every time a search and seizure is conducted.

How to effectively articulate citizen-consensual encounters

How to articulate any consensual search, and what are the many pitfalls to avoid

What is apparent authority to consent to search, and what if officers are mistaken

How to conduct an investigative detention, and how to transition to a P.C. stop or back down to a consensual encounter

Stops based on anonymous tips

3. Building solid probable cause, including these topics:

Confidential informants

Reliability of "citizen informers"

The two knowledge doctrines

Articulating constructive possession offenses

4. Dealing with homes, in particular: 

Warrantless entry to prevent the destruction of evidence

Entries based on deception or ruses

Hot pursuit entries and plain view seizures

5. How to articulate constructive possession. 

6. The two types of collective Knowledge Doctrines.

7. All about searches incident to arrest, along with the judicial push-back on "lunge area" searches.

8. Interview and interrogation law.
